TERMS AND CONDITIONS / CGV

1. Scope

These Terms and Conditions (“Terms”) apply to all property sales concluded through MOA REAL ESTATE. They govern the contractual relationship between MOA REAL ESTATE (“the Agent”) and the Buyer(s).

2. Parties

– MOA REAL ESTATE, a real estate agency based in Asunción, Paraguay, operating under the domain moa‑realestate.com. Registered address: Pancha Garmendia 6230, Asunción 001415, Paraguay.
– The Buyer, being the individual or entity purchasing the property.

3. Services Provided

MOA REAL ESTATE specializes in:

  • Property sales (off-plan and resale),

  • Rental management and leasing services,

  • Investment advisory and interior renovation guidance

4. Offer and Acceptance

  • Offers are subject to availability and must be accepted in writing by both parties.

  • A sale is confirmed once both parties have signed the Purchase Agreement and any applicable deposits have been received.

5. Price and Payment

  • The sale price is as stated in the Purchase Agreement.

  • Unless otherwise agreed, payment terms include a deposit upon signature and the balance at closing per the timelines outlined in the contract.

6. Deposit

  • The deposit is non-refundable except where required by law or in cases of material breach by the Agent.

  • Specific deposit conditions (amount, due date, refund terms) will be outlined in the Purchase Agreement.

7. Closing

  • The closing date, transfer procedures, and any related conditions will be specified in the Purchase Agreement.

  • The Buyer is responsible for any taxes, fees, or costs associated with the transfer of ownership unless otherwise stated.

8. Agent’s Obligations

MOA REAL ESTATE commits to:

  • Acting with professionalism and integrity,

  • Providing accurate, up-to-date information on property listings,

  • Facilitating property viewings and managing administrative tasks.

9. Limitation of Liability

  • MOA REAL ESTATE is not liable for indirect, incidental, or consequential damages.

  • Direct damages are limited to the amount of the deposit paid, except in cases of gross negligence or willful misconduct.

10. Force Majeure

Neither party is liable for failure to perform obligations due to events beyond their reasonable control (e.g., natural disasters, war, government actions, pandemics).

11. Privacy and Data Protection

Personal data collected will be processed in accordance with MOA REAL ESTATE’s Privacy Policy (refer to the Privacy Policy page).

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Paraguay. Any dispute will be submitted to the competent courts of Asunción, except where mandatory jurisdiction rules apply.

13. Modifications

MOA REAL ESTATE reserves the right to amend these Terms at any time. The version in effect at the time of Property Purchase Agreement signature will apply.
